Your rights on arrest under the BNSS

The safeguards every person has when the police arrest or summon them.

1 min read
  • To know the grounds of arrest and, for a bailable offence, that you can be released on bail (Section 47 BNSS).
  • To have a relative or friend informed of the arrest and the place of detention (Section 48).
  • To meet an advocate during interrogation, though not throughout it (Section 38).
  • To be produced before a Magistrate within 24 hours, excluding travel time (Section 58).
  • To a medical examination (Section 53).
  • To free legal aid if you cannot afford an advocate.

For many offences punishable with up to seven years’ imprisonment, the police must first issue a notice of appearance under Section 35 instead of arresting.
